Senate OKs bill protecting delivery riders from hoax orders

The Senate has recently approved the bill that seeks to prohibit hoax orders and protect delivery riders and drivers from fake bookings and canceled deliveries.


The Senate Bill (SB) 2302, also known as An Act Providing Measures to Protect Individuals Engaged in Food, Grocery, and Pharmacy Delivery Services, was approved during the third and final reading with 23 affirmative votes.
The Senate unanimously approved SB 2302, which prohibits any food, grocery, and pharmacy delivery service providers from requiring delivery riders or drivers to advance any monetary amount to fulfill orders. Under the measure, delivery service providers will be required to shoulder the cost of the bill in case of hoax orders.

It also requires these delivery service providers to “establish a mandatory reimbursement scheme in favor of delivery riders and drivers in case of cancellation of confirmed orders.”

Moreover, the bill requires the implementation of Know-Your-Customer (KYC) rules which shall entail submission and verification of proof of identity and residential address of customers in compliance with the Data Privacy Act of 2012.

The bill also seeks to protect the general public from fake delivery bookings by making it a criminal act.

Any food, grocery, and pharmacy delivery service provider who shall be found to violate the prohibition on requiring monetary advances from delivery riders or drivers shall be subject to imprisonment and/or fine of an amount not exceeding PHP 100,000. In addition, the licenses and permits of said violators shall also be revoked. 

The said bill was authored by Senators Koko Pimentel, Lito Lapid, Joel Villanueva and Migz Zubiri. It was sponsored by Pimentel.
