The Supreme Court affirmed the dismissals of four telecommunication companies from third-generation mobile communications technology (3G) frequency bids. In a decision consisting of 44 pages, the High Court’s Second Division denied the petitions filed from the following: Next Mobile Incorporated (NOW Telecom) Bayan Telecommunications (BayanTel) Multi-Media Telephony Incorporated (MTI) AZ Communications These companies have been denied applications for 3G radio frequency. Nokia recently announced that NOW Telecom selected Bell Labs Consulting, part of Nokia, to create a nationwide network design for 5G Standalone (SA) and design and plan for a national broadband network in the Philippines. This initiative is facilitated by the grant received by NOW Telecom from the US Trade and Development Agency (USTDA) to support the development of 5G mobile and fixed wireless networks in the country. The Court of Appeals has dismissed Now Telecom's petition which sought to overturn a Manila Regional Trial Court's decision denying its application to join the bidding for a radio frequency as a new major player (NMP). Now Telecom, however, challenged the fees required for prospective bidders, which includes a PHP 700 million participation security fee, a PHP 14-billion to PHP 24-billion performance security, and a PHP 10-million non-refundable appeal fee, saying that it was excessive and confiscatory, and brought its case to the RTC in Manila.
