DOJ warns data capping, throttling, false unli of telcos

The Department of Justice has released a second advisory yesterday warning telcos about deceiving consumers on their supposed unlimited internet services.

In a 9-page Advisory dated 09 December 2014, the DOJ expounds that the imposition of fair usage policy on unlimited internet service is inconsistent with the provisions of the Consumer Act, particularly on fair packaging as well as misleading trade practice and advertisements.

Assistant Secretary Geronimo L. Sy, head of the DOJ-Office for Competition (OFC), said that “unlimited data is like unlimited rice or buffet concept – restaurants cannot offer an ‘eat all you can’ promo and when a customer eats more than the average person, to actually stop him or not to honor the commitment.” The Advisory thereby calls on the Department of Trade and Industry (DTI) and National Telecommunications Commission (NTC) to monitor and penalize non-compliant telcos.

The DOJ, through the Office for Competition (OFC), issued said Advisory in the fulfillment of its mandate to protect consumers from unfair business practices and to advance consumer welfare.

The applicable law that of concern here is RA7394.

Republic Act No. 7394, series of 1992, known as the Consumer Act of the Phihppines (“Consumer Act”), advances the “protection against deceptive, unfair and unconscionable sales acts and practices” as well as promotes the “provision of information and education to facilitate sound choice and the proper exercise of rights by the consumer.”

Article 50 considers an act or practice deceptive “whenever the producer, manufacturer, supplier or seller, through concealment, false representation of fraudulent manipulation, induces a consumer to enter into a sales or lease transaction of any consumer product or service.”

The US Government has also pursued cases against carriers in the United States regarding their promise on unlimited internet.

how to prove the unli-capping, etc. is another
how can go to court and sue if you don’t have enough evidence to support it.

di ba mahirap e document yan kung pano kayo napuputol o na to-throttle down speed niyo or when the actual capping occurs?

i very seldom use carriers data connection, coz most of the time i’m not outside my wifi area, both home and in work place, kaya i’ve no long time-experience on mobile data usage.

As a Smart postpaid subscriber and heavy user ng youtube sa Smartphone, masasabe ko na wala namang datacap akong na experience. mahaba byahe ko from office to house, kaya wala magawa kundi mag youtube sa shuttle. laking tulong sa matining trafik

nag aaverage ang usage ko per month ng 10-15GB, LTE naman lage.

Ang tanong lang ay kung may “ngipin” ba yang advisory na yan o kung wala rin namang effect at dededmahin lang ng mga telco. Dapat sana kinasuhan na lang ng DOJ yan mga yan kaysa sa naglabas pa ng advisory na parang wala rin namang patutunguhan.

nagpapabayad lang ang DOJ kaya naglabas ng ganito.. parang NTC lang yan, netong nakaraan may ganyan din sila memorandum pero ngayong bayad na sila e di na nila pinush.. corruption at its best.

Internet access could be: TIME-based, THROTTLED or CAPPED. Internet use parameters are: TIME, BANDWITDH (data rate/ speed) and (number of) WEBSITES. True unlimited internet access is Time-limited at max bandwidth with access to any site. Anything less than this is not UNLI. Madaya sa ads ang Globe/ Smart. Sun nalang talaga ang nagpprovide ng totoong unli. Kaso minsan forced ang connection para magroam sa smart network. At pag ganun naka roam sa smart network, super bagal ang speed kahit naka set ka sa ‘3G-only’.

Gustong gawin ng DOJ ang trabaho nila pero busy ang NTC kakabilang ng under the table payment ng mga telco lobbyists. Dapat kuwestiyunin ng national government ang NTC bakit sila nagpapabaya sa trabaho nila.

LTE 50 is unlimited LTE for 1 day. So if you get throttled and in most cases when you download 6GB, you get cut off from mobile data completely for 2 days even if your subscription have not expired. That is not unlimited. And before you cry illegal torrent. I use it to download games i bought from STEAM, ORIGIN or other online stores.

Face it. Instead of these telcos fixing their network they choose to limit customers bandwidth.

This will only make the telcos stop using “unlimited” in their advertising. Take note of the new post paid plans and the lack of “unli”.

At least they won’t be tricking the customers anymore. These telcos are going to profit no matter what. They just want the easy way and charge it to customers instead of fixing their network infrastructure.

PLDT can’t even show me a document which explains their “fair usage policy”. It seems as if they don’t want clients to know exact limits. Also, there’s no way to check usage from their website. Not to mention the 30 minutes it takes for someone to answer their hotline!

Not to mention their fucking hyped Home fber costs an arm and a leg. Nagpakabit ako sa bayantel dati, tinanong ko kung may data capping sila tulad ng PLDT at ang sabi ng installer? “Ano yun? Kalokohan lang ng ibang kompanya yun.”

does PLDT really have data capping? one time nag download ako 60gb worth of data in one week then naging 130gb in 2 weeks hindi naman nila binagalan yung net ko.

basta ang akin mula nong nagdownload ako ng TV Series na 30GB size, ayon nakathrottle na speed ko max. 80kbps na lang at 10kbps sa torrent. Ewan ko lang kung epekto ng pagdownload ko ng large files or epekto ng free internet nila, nataon din kasi non launching ng freeinternet promo. Hanggang ngayon ganito pa din.

Same goes sa Smart, Heavy user ako ng Youtubesa Smartphone, no Data Cap. LTE all the way. nakaka almost 10GB ako ng data per month

Walang magagawa ang DOJ kung hindi gagalaw ang NTC para back-upan ang mga reklamo. Pero kudos sa DOJ dahil kahit inutil ang NTC gusto pa rin nilang may mangyari sa issue.
