Apple vs Samsung lawsuit, whose side are you?

Apple Inc. has been involved in numerous patent lawsuits against its competitors. One of its most recent and controversial one, is the patent lawsuit against Samsung. As the trial comes to a close, we want to whose side are you taking?

We’re not going to discuss the technicalities of the trial, but in a nutshell Apple’s patent lawsuit against Samsung revolves around two things, Design and User Interface.

In terms of design, we have to agree devices involved in this trial (25 to be exact, including the Galaxy S and S2) do bare resemblance to Apple’s design in some degree but not entirely. Regarding the user interface, Apple claims that Samsung copied three of their patented technologies for the TouchWiz UI which involves multiple gestures scrolling, zooming and panning and “scrollback”.

Samsung isn’t just going away without a fight as they also file a patent lawsuit against the Cupertino company which involves infringing their patent over 3GPP and Utility technologies and using it on the iPhone and iPad.

Of course with any other lawsuit there’s always money involved. The stakes are high for both companies. If proven guilty, Apple’ asking a total over $2 billion from Samsung for the damages that the patent infringement has caused. As for Samsung, the South Korean tech giant’s asking price for their patent lawsuit is little over USD14 for every iPhone and iPad sold worldwide. iPad units sold alone amass to approximately 67 million as of April of this year, so go figure.

The case was stated, the evidences were presented, and closing arguments were said; now it’s up to the jury to decide whether or not the Samsung is guilty of infringing Apple’s patents or the other way around. It’s going to be interesting to see the outcome of this trial.

Update: A jury just handed down a guilty verdict against Samsung and ordered the company to pay Apple damages to the amount of $1 billion. – Yuga

Samsung doesn’t give a hoot about its phones. It gets a fat subsidy from the Korean government and its main products are its chips and lcds.

And on a personal side: ang pinakabastos ay ang mga Koreano. I’ve seen how they treat their “sub-species” workers.

i’m for samsung.

a deck of cards is rectangular with rounded corners. they existed long before the iphone.

the palm pilot had icons to represent apps. palm pilots existed before the iphone.

some palm pilots did not have physical keyboards.

apple’s retina display is just marketing. more subpixels in a low-res screen.

touch screen is just innovation/improvement over the use of a stylus.

apple is just over reacting. in fact they hate android so much they’d prolly do anything to kill android. steve jobs said so.

remember the mouse that the Xerox company invented for the PC desktop… everybody is now using it… Steve Job copied it… Xerox did not complain about it… because everybody benefited… Everybody is benefiting from Apple and Samsung… So why kill the goose that laid the golden egg… These two Giant companies are just plain selfish…

It is evident that Apple revolutionized the touchscreen, and with all due respects to the other camp, I surely think that Samsung has copied much from it. In fact, Samsung has been doing this for many years already. One example would be the era the of the dual-sliding Nokia N95 where Sammy also created their own version of the trade.

Google has already warned them of the possibility of lawsuits with the way they designed their handsets (Galaxy S, S2?) and hence they are now in the thick of it.

I like Samsung as a brand, but my side is with Cupertino this time.

I can’t help it but to side with Samsung. Yes, they may have copied the design of iPhone with their Galaxy S, but with Galaxy SII and their latter phones, obviously magkaiba. Imposibleng magkamali ang buyer sa size pa lang ng S2.

Problem lang kasi, masyadong broad ang patent description ni Apple. Biruin mo, they even patent the shape. So ibig sabihin ba nun, other manufacturer should develop a STAR-SHAPE phones, kasi yung rectangle is owned by Apple already.

Even the SLIDE-TO-UNLOCK is very different from Android’s PATTERN-UNLOCK. Obvious naman eh.

Even the touchwiz UI is a different thing. Meron lang si Apple is series of icons sa ibaba ng screen and shortcuts, while touchwiz has widgets and multiple homescreens, customizable pa.

Obviously, Apple fear competition. When Galaxy S3 was released, they immediately file for injunction, buti na lang nadenied.

I am slightly sympathetic to samsung only because apple’s demands are plain outrageous. Their contention is that sales have been irreparably harmed by samsung’s copycat ways. The truth is, all their sales figures seem to suggest otherwise. And number two, who the f*ck is dumb enough to buy a samsung android phone thinking it was an apple iphone?? All you have to do is look at the back for that apple logo. I’m with THECORRESCODE here. When you’re spending 30k up for a gadget, is it really so inconvenient to take the time to look at box and see if it says apple or samsung?

Apple didn’t revolutionize the touchscreen. They revolutionized the way people viewed the smartphone. No longer was it for suits with power meetings and power lunches (whatever those are). Instead, he showed what the masses could do with a smartphone if they had one. Admittedly, having a full touchscreen made it easier for people to accept the smartphone as more than a business tool. Still, it isn’t the touchscreen that is on trial. It’s the use of the rectangular shape with rounded corners. And they have a patent for that. No, seriously, they do.They wanted 2.5B from samsung to be able to use the rectangle.

Samsung’s wireless patents, on the other hand, have more substance. And even apple accepts that they have to pay royalties. HOwever, samsung’s demands were, according to Apple, similarly outrageous, and apple countered that it was too high and should be lower. And 2.5B for a rectangle isn’t?

To be clear, of the 2.5B demanded by apple, some of those were for the bounce on overscroll, and some other scrolling/navigation stuff, but the bulk of that demand was for “design patents.” That is to say, for the use of the rectangle and possibly squarish icons on a grid. 24$ per unit for the design patents alone vs 14$ per unit for samsung’s wireless patents. Now tell me, who’s being the d!ck?

With that said, I’m on the side of the consumer. That is to say, this farce should never have gone to trial and should have been sorted out outside the courtroom. And the US patent system needs some serious overhaul, especially with regards to software patents and the ever vague “design patents.”

You will see how cognitive dissonance works if Apple releases versions of iPad and iPhone with a different screen size. Remember how people glorified those -perfect- sizes because Jobs said so? They will still do even if Apple releases a 7″ table and an iPhone with a bigger screen. I do remember Bulaong wrote something saying to imply that the size of the current iPhones are ergonomic considerations. I do not know what he will say should that change.

Siri is an innovation? WTF… All Apple did was buy the company, and bake Siri application into iOS and claim it as new. Similar existing application like Vlingo and SpeakToIt has been available to Android way before Siri was introduced by iOS. And by the way, thanks to Siri, Apple has now a technology to support their patent (unified search). Trollness at its finest.

You even consider retina display as innovation? Come on, it is just LCD with higher pixel and nothing more. It is not even Apple’s technology to begin with, but LGs.

iPod is nothing more than just another MP3 player. All Apple did was to make a hype out of it.

And proximity sensor, isn’t those already in existence before Apple’s. And Microsoft own the patent…

Apple side but..

Design wise and considering that some apple chip set are from
Samsung they can “copy” since they know what apple products are made of. I’m not really following this patent war, but the the ‘rectangular’ issue against Samsung is baseless. It’s like Samsung should make phones and
tablets in other shape.

If apple wins, the free OS, the open source idea of the android will take a big hit. The real revolutionary in our time is not Steve Jobs with his cult like showmanship, but closed and his hipocracy regarding his OS that beats its chest in screaming that it will let you free yet crushes you with limiting what you can do to a product that you pay for. The Android OS is a true and silent revolution in itself, letting everyone who has ever had contact with it the freedom to do and to mold it and themselves to what ever they want to. From changing the way their phones work, look and feel to literally do everything from something as simple as letting it be a memory stick, to the android smartphone that can be a movie player, to sharing anything one can think of to friends and family… The IOS cannot and will not allow you to do even a simple exchange of photos or even video clips, memories we cherish we can share via an android phone can be shared to any one or anything even not android phones, be it symbian, or blackberry or a pc.

This lawsuit is not over yet cause the losing side will appeal to the higher court and will continue appealing until they reach the Supreme Court. The Supreme Court will then issue the final verdict in regard to this lawsuit.

Hopefully, Apple should win this lawsuit; otherwise, Apple will lose the mobile market share to Android branded phones just like Apple loses the market share of PC to Microsoft in the 90’s after the Supreme Court sided with Microsoft in Apple’s lawsuit against Microsoft.

1st answer: So what about Samsung omnia, lg prada, etc.. ang mga high ends before iphone is full touch na right?

2nd answer: Progress in technology is inevitable. Steve just successfully made a market. di mo ba naisip na if hindi naging market yung iphones eh mas maganda pa sana na-present ng ibang innovators? e.g. straight to “GOOGLE GLASS”.

And have you seen thow mac book pro look alikes from HP, Acer, Sony etc ? People don’t realize that Apple perhaps spent millions of dollars studying those designs, analyzed how people use their phones or for notebooks, best way to utilize keyboards so that it’s enjoyable and useful for everyone before mass producing it and then someone else will just copy that ? Go and figure that out.

Samsung copied Apple period. Go and figure out from the time that Samsung came out with their own Smartphone til the time that Apple released theirs. And no, they are not douchebag. They are only protected what they created first. They were the first ones to introduce capacitive screens, when everyone else is using resistive screens, first ones to use accelerometer and everyone followed and first to use all icons on a phone and it just works and then everyone wants to copy it. It’s like seeing a Ford Fiesta on the road with a Cherry tag on it. That’s how I see it.

You just go through the history of Apple and Samsung products, even a child would know which are the copycats.

We Filipinos love things that are free, even the things that are considered illegal (‘free’ download of music, movies and paid apps, and when we are asked to buy for those items that we considered “free”, nagrereklamo tayo at ayaw nating magbayad…

That’s what Samsung did with the Apple products, why would they innovate when they could just copy Apple’s patents and sell affordable phones with iPhone like experience?

And they will be paying for what they did…big time.

The jury who would acquit Samsung would be considered blind or have no knowledge about patents at all…

Apple’s such a douchebag they want the whole smartphone market for themselves. Revolutionary, yes. But to say they own everything that iPhone has is so ridiculous.

They are actually raging against Android. But since Google is not selling Android, Apple sued the closest manufacturer they found: Samsung. Sammy’s products may look like an iPhone BUT THEY’RE NOT EXACTLY ALIKE. Apple doesn’t have a back and menu buttons.

Apple’s claims are beyond ridiculous. They think they invented the rectangular shape. THey think they invented the home button. They think they invented the touchscreen.

Not a single f*** was given when Mercedez Benz, BMW, Audi, Mazda and Honda made vehicles with four wheels with a circular steering wheel and 6-speed gear. Same with refrigerators, televisions, washing machines, and ovens.

Samsung all the way!

Ronnie, I must admit it is really tough to take the side of either one. I would normally side up with Apple because I see why they began this lawsuit in the first place.

But then again Samsung has to win because if it doesn’t then Samsung or any other company will have a tough time making mobile phones or tablets to satisfy every consumer.

I just want to see the two “kiss and make up”. They can discuss a small fee to be paid when a certain patent is used.

I must admit, mas kampi ako sa Samsung kahit pa I own an iPhone 4S. Grabe ang Galaxy S3 and Galaxy Note pag tinabi mo sa iPhone 4S. Madali kasi ako magsawa sa phones, so at that time, I decided to switch to an iPhone from Android.

Samsung – INNOVATIONS BEFORE MARKETING.
Apple – MARKETING. Period.

I might consider going back to Android. Depends on the Galaxy Note 2, Sony Xperia T or Motorola Droid Razr HD.

And I have to agree with you. Apple is doing a great job marketing / promoting their products. But come to think of it, an awesome product is useless to a company if they can’t sell it. They need money.

Apple’s doing it right.

Those are NOT innovations.

Those are IMPROVEMENTS, coated with silly MARKETING strategies to make it look like it’s the “WORLD’S FIRST” or the “WORLD’S BEST”.

If they do innovations, how come they have to hire companies like SAMSUNG, LG, Sony, Sharp, etc. to do their hardware?

Isn’t it that innovations should be produced by APPLE itself?

For example. “Retina” display is not an innovation. It’s just a marketing gimmick to sound revolutionary. You just cramped the pixels into a small-sized screen. That’s it. Package it as “Retina”.

San ka naman nakarinig ng FOLED screen made by Apple? WALA. Yan. Yang ang innovation. Done by Samsung. Invented by Samsung.

Just my two cents.

Additional comment. I don’t care who copies or what. What is important if a tech company like Samsung can make a better product out of Apple’s design as accused.

So far Samsung is doing a marvelous job on making good quality Android smartphones. A friend of mine who is an Apple iPhone and iPad got curious of Samsung Galaxy SIII and Samsung Galaxy Tab 2. He lends a common friend’s Galaxy SIII and Tab 2 for a week. After that he disposed his iPhone 4s and iPad 3 and bought a Galaxy SIII and Tab2. He even bought a Nokia Lumia 800 for his second line. He has amazed how fast Windows Phone is.

Similarly, if Samsung wins, do you really believe that Apple will suddenly slow its aggressive development of the iPhone and iPad? It’s certainly not what happened last time they lost one of these cases. ”

I cant seem to like a company that patents shape and patent trolls it to everyone. Good thing Apple seems to be the only company that did it.

imagine if others did it like Henry Ford.

When Henry Ford made his car then saw other manufacturers make cars that has similar designs from him.

He probably thought that “These guys are copying my style”.

Good thing instead of suing he went the other way which should be what apple should have done

He went with ” Ok lets make my next design better than all the others”

ever notice that the steering wheel, gas, brake and clutch are usually eerily similar in all cars? and is that a bad thing?

Of course SAMSUNG!!! Apple wants Google’s Android OS destroyed according to Apple’s founder Steve Jobs. Samsung is Google’s biggest and most successful client. They are now the No. 1 mobile phone maker and now poised to overtake Apple in the tablet business.

If Apple wins, Samsung will fall and others are next – HTC then LG then Sony. These are the other manufacturers who support Android.

Microsoft’s Windows Phone 7.5 OS has a small market. But I find their OS very amazing! I own a Nokia Lumia 800 and I’m excited to see the new Lumias with Windows Phone 8. For now it cannot stand a chance against Apple’s iOS with more than 600,000 apps vs Windows Phone with 100,000 apps.

Samsung MUST WIN!

First of all, I don’t follow the patent wars, but I do occasionally read articles about it. Let me know if I have some facts wrong on this :-)

I want you agree with you and side with samsung on this one, but there are too much evidence that samsung tried to copy apple… (interface wise, I find the physical appearance “copying” completely ridiculous) Really disappointed :-(

Samsung needs to face the consequence, but the billions being demanded by apple is completely idiotic and it was definitely out of greed, they want samsung out of the competition and they’re trying to make some money out of it -_-

Personally, I think they should have ended it with a settlement and leave it at that… But I guess both sides are too arrogant and greedy to agree on a truce >_>

Btw, I don’t think apple would ever think of going against sony. The iphone 4/4s was based on a sony concept, a lawsuit against sony would easily backfire lol

@Ghost Riley – Its is simple. I HATE APPLE. Nuff said.

@ Ramon – Its is simple. Sony manufactures Android phones. Sony’s concept design was years ago. Now Apple has its own designers and Sony’s competitor Sharp is are the ones manufacturing the screen panels for iPhone. True it may backfire on Apple but lawyers has its ways.

As for greed, every business whether food, services, consumer electronics the all want one thing PROFIT. making money out of everything is their goal. What I care about is they make sure their products are of excellent quality.

Why do i have this feeling that Apple supporters here are blindsided about the truth.. Follow the trial..

Steve Jobs on his own words said that he “Invented touchscreens,” but guys hear the Diamond touch argument.
