Epixtar Philippines closes, sheds 650 agents

In an SMS correspondence with a former Epixtar employee, it was revealed that the BPO company has closed its offices in Eastwood City, Libis last January 16 leaving employees confused and anxious for answers.

epixtarAllegedly, Epixtar suddenly closed its operations in the Philippines without properly informing and arranging severance packages of hundreds of its employees.

My source, who wants to remain anonymous, also added that they were not given any separation pay and found out that their SSS and PAG-IBIG contributions were deducted from their salary but were not remitted to the proper agencies. Salary loan amortization to Union Bank were not remitted since the November 20, 2008 pay-out.

It would seem that a new company, Amberbase Solutions, took over the operations along with more or less the 650+ employees (everything is the same, except the name of the company). Only about 10 people were not offered a new contract and escorted out of the building on the same day Amberbase took over.

No email or memo were sent out so everyone is confused and in the dark what really transpired, according to a source who wants to remain anonymous (and is now employed by Amberbase).

I did a little digging and found the domain amberbase.com was registered last November 19, 2008 and points to SkyINet, a local hosting provider. The website is still under construction as well so it checks out that Amberbase Solutions is a very new company. The WHOIS information is also private so we can’t shoot a quick email to verify this.

Epixtar filed a Chapter 11 Bankruptcy Protection last October 7, 2005.

Epixtar closed so that they wont have to bother about it’s back pay and/or the contributions of it’s employees…

i know that because it is the exact same thing that happen to Air Relay Corp..

I’ve read the posts after mine. And the only thing that popped into my head is, hindi ko to pwedeng palampasin lang. Yup, I do have work right now, pero yung perang inaasahan ko sa epx ay hindi basta basta lang ang halaga na pwede kong balewalain.

That’s why I’m so angry with Epx, at ang mga taong nagpapatakbo nito. Grabeng panloloko ang ginawa nila o ginagawa pa rin nila to all those who thought that this company was a good one to work in.

I’m sorry Bam if na hurt ka sa mga comments ko, pero I couldn’t help it coz since you represented them, ikaw ang napagbuntungan ko. So natanggal ka na rin? ganun na lang ba yun? ang pwede na lang gawin ngayon eh mag email sa epixtar.com na website para mag follow up? what good will that do? I already did that, the same day na nagpost ako nung Feb 8 pero walang reply.

My plan is to approach Mr. Tulfo sa Bitag pero I believe mas may impact if there were a lot of us who will come out and complain at the same time diba?

So please, sa mga gusto pang lumaban kagaya ko, let me know, let’s work something out. Sa hirap ng buhay ngayon, sobra na kung wala ka na ngang pera eh magpapa-api ka pa.

a clean advise to amberbase solutions
dont kill your I.T. professionals,indeed they were only a few left for them. and obviously this reflects on the equipment on floors which was less maintained and thus results in unproductiveness of an agent. fatigue also was seen on this department. i know they are not happy as much as many of us

No back pay and I accept ( kikitain po pa yun so iaabuloy ko na lang sa management, lalo na sa head ng educ dept. Yes sha pa rin!) I feel good that I left because I was soooo tired ( of everything!). But it’s tragic that a lot my best buddies are still holding on. You guys have the skills & knowledge, don’t think otherwise! You deserve better. Tho I’m happy that I was trained by the best when Epix was still at its peak. I am still thankful that I learned a lot.

EXPLOITED!!! That’s what you are all guys (EXP & amberbase agents). You’ve wasted ur talents & skills ( for those resigned/retrenched ) and continue to be abused and fooled (for those who were kept) by these people. You’re all partly to blame for the mess you’re in right now. You’ve allowed these scammers to be their pawns in their evil wrongdoings of scamming people. You all gave in to their trap of big base pays, commissions, etc, etc,etc.They may have legit campaigns (before?/sometimes?)but according to some insiders, these are just for cover-ups.Pitiful young,talented,skilled, and smart Filipinos. Deprived of your rights! Damn it! Injustice was done again in our very own country by you-know-who. Young aspiring Filipinos who are hoping to provide a decent living for themselves and their family in this poverty-stricken country are once again abused and manipulated by professional blood-sucking thieves. So, what now? In your case,a total of 650 (more or less) agents fooled and deprived of benefits? Well,kuya Mike’s show may take it in (let’s see what he’s got to prove). Why not let those thieves in EPX and this so called ‘new company’ be exposed live on national T.V., and let others be forewarned. Or Mr. TULFO might even be interested in your case. Better yet, why not air your grievances to the right commitee on CONGRESS, so these kind-hearted execs of yours be summoned and investigated. If found guilty of any wrongdoing, hopefully they’d all be catapulted back where they came from. There are many avenues for you to be heard… just need to make up your mind and speak up. this is Bam, I was once an agent, QA, Employee Relations Associate,Employee Relations Officer (HR) and finally Employee Relations Officer con Legal Secretary of our beloved Epixtar.. Yes, I was tasked to attend all the hearings of cases pending before the NLRC.. I was always instructed to schedule payments after pay out which would be either the 5th or 20th of the month.. To all those I have talked to before the NLRC as the representative of Epixtar.. Guys.. please accept my hearfelt apology, I didnt mean to give you false hopes. I was in the belief that the company could still pay … we are in the same boat now.. after all the sacrifices and the representations I have done for Epixtar upon the instructions of Atty. Arnel Ordas. At first I felt bad that I am no longer with the company, I missed my inbound and Hr families, as well as the agents, sups, sms and the rest of the support group.. but later on I realized I should be thankful.. at least I wont be there anymore and be part of the scam……Lastly, since you know my number, please keep in touch. Thanks!

huwaat?? nagpunta ka na din nlrc and walang nangyari?? omg.. so ibig sabihin wala na akong dapat asahan??? im scheduled for hearing next week.. so should i expect na walang sisipot na representative from epix?? this is sooo bad.. this is against the law.. kelangan ko din ung back pay na un.. how can this be resolve??

Mahaba to pero worth basahin:

I was a former employee too. Resigned last Sep ’07 at sinabihang makukuha ang cheque ko after 2-3 months so I didn’t bother following up during that time. After the 3rd month, that’s when I started calling them at ang laging excuse na sa tingin ko ay kinabisado nila by heart para sa mga nagfa-follow up ng back pay ay “wala pa po kasi ang ni-request namin na funds..blah blah blah.”

They would always say that since they have your contact number, they’d call you to follow up. Siyempre di ako satisfied sa ganun dahil walang kasiguruhan na tatawagan ka nga nila. So I keep calling them and one time na may nakausap ako, here’s how the conversation went:

Me: “follow up ko lang yung backpay ko?”

EPX: “ano po last name nila?”
-bigay ako last name ko.

EPX: ay ma’am wala pa po name niyo sa list.”

ME: “pano yun eh ang tagal ko ng nagfa follow up? kelan ba kayo huling nagbigay ng backpay?”

EPX: “nung June po, pa ilan ilan kasi ito po yung mga nagsampa ng kaso.” (June 2008. This call I made was around September 2008, nearing the first year since nagresign ako sa pesteng kumpanya na to)

ME: “kelan nagresign tong mga nabigyan na ng backpay?”

EPX: “mga 2007 po.”

ME: “so ibig mong sabihin sa 2009 ko pa makukuha ang backpay ko? (in a really sarcastic tone) at kung magsasampa ako ng kaso, ibibigay niyo rin ang backpay ko?”

EPX: “opo”

YUN NA! I didn’t get her name but don’t you think that the utter stupidity of the answers I got from her would be enough to show how shameless and worthless this company is!

A week after this encounter over the phone, I went to NLRC and Epx was requested to appear for Mediation twice na parehong hindi nila sinipot dahil wala raw sila nareceive na notice. Nag-decide ang Mediator na akyat na sa Arbiter at maging kaso na siya. Nag-schedule na naman ng meeting and again, twice no show ang mga taga-EPX until the third reset at dumating si Bam na HR rep ng EPX since yung talaga daw pupunta couldn’t make it.

Napaka-jolly pa ng character nito at tinatanong pa ko kung ano daw account ko before at kung sino ang TL ko na kilala pa niya. Ang sabi ng mahusay na si Bam ay release nila ang cheque by December 20 or before that.

Ako naman si tanga naniwala and was given her cellphone number, local niya sa EPX pati ang local ni Mela at Dada na kahit kailan eh wala naman akong nakausap dahil hindi nila sinasagot ang phone!

Ayun natapos ang holidays at February 2009 na! I went to EPX last Feb 5 at nakausap ko si Dada na sinabing nabili na daw ang EPX at wala na silang record ng mga former employees at ang pwede ko lang daw gawin ay maglog on sa epixtar.com then click “contact” at dun ko daw ilagay ang complaint ko.

Anak ng P*tA tong mga taong to! Mga walang kaluluwa! Mga walangya talaga!

I’m currently 7 months pregnant at tong makukuha ko dapat sa Epx I was planning to use just in case kapusin ang savings ko, pang back up ba. pero dahil mga hayop ang may ari ng Epx, I don’t think they give a damn maski malapit ka na mamatay kakahintay ng back pay mo.

If there’s someone who can help out, mas okay kasi pag marami nagreklamo all at the same time. To all those na ginago nitong kumpanya na to, here’s the time to get back at them!

I’m planning to go to one of the TV networks for this.

i was a former epixtar employee and naghahabol ako ngaun ng back pay ko. to those who want to file a complain against epixtar, you can go to NLRC (national labor relations commission) and they will assist you with any of your issues. buti na lang nagresign na ako agad jan. i was kinda shock to know na hindi rin nila nireremit ung mga contributions sa pagibig, sss and all that. i guess the case against them will be stronger kung as a group kaung magffile.

naging sup ako sa epixtar … i should say maraming hokus focus talaga ang company na ito . may concern is nung ng try ako kumuha ng coe sa kanila.. hindi daw pwede kasi epixtar doesnt exist na daw… ano yun may ganon talaga? hindi bale na yung back pay e … abuloy ko na sa kanila yun … ayoko ma void ang pinag hirapan ko doon dahil sa kalokohan na nila…

i am currently employed with amberbase. i can say that the campaigns are still there and what i really find odd, like the others are saying, someone took over the company but the same old admins are there. i don’t know what the hell is going on and why are they suddenly pleading that we all address our concerns to epixtar miami when in the first place, the people in the financial dept are the ones who calculate the rates and places our money in the ENVELOPES – yes envelopes because we don’t get the salary through a decent atm previous to the take over.

bottom line – they are the same people who worked to scam me of my benefits. why are they washing their hands now that they have wiped them in a towel named amberbase solutions?

wtf, my 500 charge for SSS was reflected on SSS’ end as a 100 peso contribution and last updated payment was made in march. the same goes to our philhealth and pag-ibig contributions. our medicard has been suspended since december. OUR BIR payment, i believe, is also not updated. what have we done so grave when we have been faithfully working for them all these time. it’s a betrayal but we all need work and that is why we are patiently waiting for results as we quietly say our hellos day in and day out.

Just a piece of advice for the Filipinos who were instrumental in perpetrating this scheming acts to defraud their fellowmen….perhaps for a big sum of money or maybe to save their asses!!!!! guys, the legal system in the Philippines may be slow.. but it is still in place.. we very well know our rights and the violations you have done… Mark our word..Justice will prevail in the end and you may say goodbye to your dear professions….tsk tsk tsk..til we meet again…

hi, im a previous employee from this company.. i too was retrenched or as might as well dismissed on the day said transition occured. I really dont know what papers I may have need to fix to settle things on my side. Im a rookie as a worker. Can somebody help?eheheh

Anyways, I just hope everything will be fixed and everything will be fine.

Art. 258 is not applicable on the case of epix because the case was not as mentioned.

the company and the employees was absorbed by the alleged “new company” which is Amberbase because the later suffered from chapter 13 bankruptcy since 2005.

but at any rate, the said “alleged turnover is really anomalous and a gigantic fraud on the part of the employees especially for those who’s more than a year in the company..

there should be a clear answers from the management to the so many questions we have as employees. And we should have the answer that we want or else we shall take the necessary legal actions.

A fraction of at least six (6) months shall be considered one (1) whole year.

“THIS WAS NOT DONE BY THE COMPANY” – THEY TERMINATE EMPLOYEES WITHOUT EVEN NOTIFYING EACH ONE OF THEM> NO SEPARATION PAY WAS ISSUED NO CERTIFICATES NO STATEMENT OF ACCOUNTS…..NOTHING…

Title I
TERMINATION OF EMPLOYMENT

Art. 278. Coverage. The provisions of this Title shall apply to all establishments or undertakings, whether for profit or not.

Art. 279. Security of tenure. In cases of regular employment, the employer shall not terminate the services of an employee except for a just cause or when authorized by this Title. An employee who is unjustly dismissed from work shall be entitled to reinstatement without loss of seniority rights and other privileges and to his full backwages, inclusive of allowances, and to his other benefits or their monetary equivalent computed from the time his compensation was withheld from him up to the time of his actual reinstatement. (As amended by Section 34, Republic Act No. 6715, March 21, 1989)

Art. 280. Regular and casual employment. The provisions of written agreement to the contrary notwithstanding and regardless of the oral agreement of the parties, an employment shall be deemed to be regular where the employee has been engaged to perform activities which are usually necessary or desirable in the usual business or trade of the employer, except where the employment has been fixed for a specific project or undertaking the completion or termination of which has been determined at the time of the engagement of the employee or where the work or service to be performed is seasonal in nature and the employment is for the duration of the season.

An employment shall be deemed to be casual if it is not covered by the preceding paragraph: Provided, That any employee who has rendered at least one year of service, whether such service is continuous or broken, shall be considered a regular employee with respect to the activity in which he is employed and his employment shall continue while such activity exists.

Art. 281. Probationary employment. Probationary employment shall not exceed six (6) months from the date the employee started working, unless it is covered by an apprenticeship agreement stipulating a longer period. The services of an employee who has been engaged on a probationary basis may be terminated for a just cause or when he fails to qualify as a regular employee in accordance with reasonable standards made known by the employer to the employee at the time of his engagement. An employee who is allowed to work after a probationary period shall be considered a regular employee.

Art. 282. Termination by employer. An employer may terminate an employment for any of the following causes:

1. Serious misconduct or willful disobedience by the employee of the lawful orders of his employer or representative in connection with his work;

2. Gross and habitual neglect by the employee of his duties;

3. Fraud or willful breach by the employee of the trust reposed in him by his employer or duly authorized representative;

4. Commission of a crime or offense by the employee against the person of his employer or any immediate member of his family or his duly authorized representatives; and

5. Other causes analogous to the foregoing.

An employer may terminate the services of an employee who has been found to be suffering from any disease and whose continued employment is prohibited by law or is prejudicial to his health as well as to the health of his co-employees: Provided, That he is paid separation pay equivalent to at least one (1) month salary or to one-half (1/2) month salary for every year of service, whichever is greater, a fraction of at least six (6) months being considered as one (1) whole year.

Art. 285. Termination by employee.

In all such cases, the employer shall reinstate the employee to his former position without loss of seniority rights if he indicates his desire to resume his work not later than one (1) month from the resumption of operations of his employer or from his relief from the military or civic duty

Magagaling pa naman ung mga IT Personnel dito… very friendly and approachable… Sayang nga lang at binawasan na naman sila dahil dun sa transition na nangyari… ngarag ngayon ang mga IT kasi konti na lang sila, tendency nun konti lang mabebenta ng agent kasi matagal pa bago maayus ung headset or ung PC dahil sa konti lang ang mag-aayus nito…… Haaayyyy!!!!…….

A very good tactic for covering up their dirt! tsk tsk. i believe in karma and i think these people will get what they deserve sooner or later. buti na lang hindi ko itinuloy jan sa epixtar ang career ko.

This maybe true… but all I can say is let’s pray for those people who are affected with this very sad & unexpected events. Let’s also pray for the following intentions.

* We pray for good and success of those people who are still working under the new company. We thank the Lord that all these people still have their work.

* We also pray for the good and success of those people that who already made up their minds to step out and move to pursue another set of career.

* To the new company we pray for its success and wishing that whenever you heard of its name, may it become something that you can be proud of because you become a part of it organization. Let’s
pray that the new company will not encounter the same the trials & obstacle or will not repeat the same mistakes of the previous company.

That’s really ridiculous!!!
LOLZ… Knowing that they are the same people who are working there and member of the administrative buddy, now they’re telling you that they dont know anything and that’s just from the Epixtar days, what the hell it is not yet a week ago so why do they forgot what happen. They are really paid for that, definitely.
This is really one of the major reason why working in the Philippines is very very very doubtful. It is the reason why most of the best professionals are in other countries.

Ang masaklap nito ung dating management ng EPIXTAR ay sila pa rin management ng AMBERBASE SOLUTIONS! From HR(Joel Yap), FINANCE and PAYROLL(Lanie Reyes, Peter Bonto, Edward Menor, Cindy Aran, Carl Baltazar, Michelle Samonte, Jennycel Maliwanag, Mary Love Odon, Elwin Mariano ), LEGAL (ATTY. ARNEL ORDAS) and EXECUTIVE Management (JOHN CALLAGHAN and ROBB AUBER)…whenever someone ask questions, bringing up concerns regarding the issue as if wala silang alam…lahat sila isa lng sinasabi “Hindi na namin masasagot yan, EPIXTAR pa po yan…we’re now under the management of AMBERBASE”. Todo deny sila na “WALA SILA ALAM” sa nangyari. Pati daw sila nagulat na lng…which is impossible. Lalo na kung LAWYER (Atty. ARNEL ORDAS) ang nagsabi sayo nyan…..tsk….

Yung mga tao sa payroll and finance, since APRIL 2008 pa hindi sila nag remit ng SSS, PAGIBIG and PHILHEALTH. Pati ung mga Bank and SSS loan na binabawas nila sa mga empleyado hindi nila binayad. Grabe ang ginawa nila sa mga dating EMPLEYADO ng EPIXTAR. May duda na nabayaran ang mga taong ito para tumahimik at magsawalang bahala.

iM currently employed in amberbase solution (formerly Epixtar). Some of us are very confused regarding our contributions in SS, philhEALTh, pagibig and even our taxes.

I received forwarded message from unknown person. The text contains,”hindi naremit lahat ng kinaltas s ss,tax,pagibig,philhelath,ibank loan mula march 08.Nabayaran n ang hr at management para tumahimik.Plabas lng ang change of name para d n mghabol mga reps.,truth is epixtar still exist! dahil wala namn daw mgrereklamo. tuloy p rin operations. enuf is enuf, management is avoiding our questions.wear black tonyt as a sign of protest. Simula plng to ng pagkalampag natin s epixtar. Lets voice out our rage en claim wat is rightfully ours.”

Ive been working in epixtar since march2008.The campaigns are still the same. But, The whole contributions that has been deducted from my income is extremely unacceptable coz of this irregularity.

Jeez, this is really been bothering me. I have a plan in applying to a new company but as I can see one-by-one most of the company are closing. I come to think that I should be think more than twice to the company I will applying knowing that even Intel, a huge worldwide company is closing. Even the Sony TV factory in Japan I think is closing also. This is really troublesome for all of us.
We should hope that Mr. Obama can really been a factor for “change”.

Another company down due to global economic crisis? Oh my. And this sound worse than Accenture Manila. What if tha Malacañang will close, and the reason is economic crises? (lol). I don’t want to hear another one falling, but hey, this is the real world.
