राजपत्र ने साइबर अपराध कानून पर अंतरिम आदेश रद्द करने की मांग उच्च न्यायालय से की है।

साइबर अपराध विरोधी अधिनियम 2012 (R.A. 10175) को पिछले अक्टूबर 9 को सर्वोच्च न्यायालय द्वारा जारी एक अंतरिम आदेश (TRO) के कारण स्थगित कर दिया गया था। जनवरी 2013 में, सभी पक्षों से मौखिक तर्क सुने जाएंगे, जिसमें TRO के लिए दायर करने वाले 15 याचिकाकर्ता भी शामिल हैं।

इस सप्ताह, सॉलिसिटर जनरल के कार्यालय ने उच्च न्यायालय से R.A. 10175 पर अस्थायी रोक हटाने का अनुरोध करते हुए 148 पृष्ठों की टिप्पणी दायर की।

तब पिछले महीने, ब्लॉगर और यूट्यूबर जोसे फर्रूगिया पर भी उनके पड़ोसी (जो एक दूर का रिश्तेदार भी है) द्वारा ऑनलाइन गाली-गलौज के लिए YouTube पर उनकी मौखिक बहस का वीडियो अपलोड करने के कारण मुकदमा चलाया गया था।

Establishing the existence of malice in a libel case is really hard. Dunno, but there is no need for this provialsions bec libel is already covered by the civil code.

Let’s just forget about the politicians and think about these small, day to day happenings that require a law to back them up when stupid people do stupid stuff against them.

Kind of funny how eager they are to enable a law that can so easily be exploited. Rather than rushing to get that TRO lifted, they should iron out the kinks in the law that’s getting everyone riled up.
