ARTICLE 50.
Prohibition Against Deceptive Sales Acts or Practices – A deceptive act or practice by a
seller or supplier in connection with a consumper transaction violates this Act whether it occurs before,
during or after the transaction. An act or practice shall be deemed deceptive whenever the producer,
manufacturer, supplier or seller, through concealment, false representation of fraudulent manipulation,
induces a consumer to enter into a sales or lease transaction of any consumer product or service.
Without limiting the scope of the above paragraph, the act or practice of a seller or supplier is deceptive
when it represents that:
a) a consumer product or service has the sponsorship, approval, performance, characteristics,
ingredients, accessories, uses, or benefits it does not have;
b) a consumer product or service is of a particular standard, quality, grade, style, or model when
in fact it is not;
c) a consumer product is new, original or unused, when in fact, it is in a deteriorated, altered,
reconditioned, reclaimed or second-hand state;
d) a consumer product or service is available to the consumer for a reason that is different from
the fact;
e) a consumer product or service has been supplied in accordance with the previous
representation when in fact it is not;
f) a consumer product or service can be supplied in a quantity greater than the supplier intends;
g) a service, or repair of a consumer product is needed when in fact it is not;
h) a specific price advantage of a consumer product exists when in fact it is not;
i) the sales act or practice involves or does not involve a warranty, a disclaimer of warranties,
particular warranty terms or other rights, remedies or obligations if the indication is false; and
j) the seller or supplier has a sponsorship, approval, or affiliation he does not have.
ARTICLE 51. Deceptive Sales Acts or Practices By Regulation – The Department shall, after due
notice and hearing, promulgate regulations declaring as deceptive any sales act, practice or technique
which is a misrepresentation of facts other than those enumerated in Article 50.
ARTICLE 52. Unfair or Unconscionable Sales Act or Practice – An unfair or unconscionable sales act
or practice by a seller or supplier in connection with a consumer transaction violates this Chapter whether
it occurs before, during or after the consumer transaction. An act or practice shall be deemed unfair or
uncionscionable wh enever the producer, manufacturer, distributor, supplier or seller, by taking advantage
of the consumer’s physical or mental infirmity, ignorance, illiteracy, lack of time or the general conditions
of the environment or surroundings, induces the consumer to enter into a sales or lease transaction
Grossly inimical to the interests of the consumer or gross one-sided in favor of the producer,
manufacturer, distributor, supplier or seller.
In determining whether an act or practice is unfair and unconscionable, the following circumstances shall
be considered:
a) that the producer, manufacturer, distributor, supplier or seller took advantage of the inability
of the consumer to reasonable protect his interest because of his inability to understand the
language of an agreement, or similar factors;
b) that when the consumer transaction was entered into, the price grossly exceeded the price at
which similar products or services were readily obtainable in similar transaction by like
consumers;
c) that when the consumer transaction was entered into, the consumer was unable to receive a
substantial benefit from the subject of the transaction;
d) that when the consumer transaction was entered into, the seller or supplier was aware that
there was no reasonable probability or payment of the obligation in full by the consumer.
e) that the transaction that the seller or supplier induced the consumer to enter into was
excessively one-sided in favor of the seller or supplier.

I am really fed up with Smart. Ang malas ko lang walang ibang internet provider na available sa area ko.
Akalain mo, isa pang palpak sa system nila, yung billing ng accounting naka-tie up sa connectivity natin.
Last March 8, nag-crash yung accounting software nila. Kaya kahit active pa yung account mo na-disconnect. Grabe. At dahil sa kapalpakan nila at nawalan ako ng connection, nawalan ako ng isang kliyente. Sumulat na naman ako to air my disgust. Copy furnished NTC, DOTC, as always. Ayun, kontodo apologize na naman ang mga peste.
Today I wrote another letter informing them that I am collecting all the times and details that they have let me down. And informed them that I will decide later on what I will do with the information that I will collect and already have in my possession.

hi im a ex-costumer before, i hate your connection its very slow, 1 time nwala talaga ang conncetion ko ewan kung bakit, pumunta aku sa smart office,(ozamiz branch) they said they gonna fix it, they send somebody to fix it, peru it doesnt take long di nagtagal balik sa dati i call the costumer service many times, not only 1 time, they said it be ok, i takes to long, sabi ku sa kanila, ayaw kuna , sabi nla kailanagn daw mgbayad aku n full, and then i didnt pay for, it,.kayu ba babayad ba kayu ng hindi nyu nman na paki nabangan? dba? so what i did is everytime they send me a bill i wont, pay it, coz its unfair, and now they send a noticed that they will bring it to court,they will file a case for me, and its not my problem coz. i been many times to there office and i call the costomer sercives many time, and they said i dont compplain, i did i swear to god, i was thinking taht maybe there people who works there are so stupid, they said that i son complain i ddi, and now the make it big,the main thing is our nieghbor (foreigner from holland), he complains and they stop sending them bills or the disconnect them ,thats very unfair it seems discrimenation, right? so i want to talk to an agent or maneger or in charge and pls give me your contact number, im in california right now and i need to hold to somebody who i can talk to regarding in this problem, pls i really need your answer,,,,,,,

Guys, I hope you will really heed my advice na sulatan ang NTC (ntc@ntc.gov.ph) at sabihin ang lahat ng details nyo, be as honest and detailed as possible ha kasi isesend nila ung letter nyo mismo sa SMART eh at titignan kung totoo.
pagkatapos nun magsulat kayo ng letter of termination & request to waive the lock-in fees. idetalye nio po lahat ng paghihirap niyo at iadress nio sa manager ng smart wireless center. kakausapin kayo nun at pagdasal niong pagbigyan kayo tulad ko po ehe

Sya nga po pala, bukod sa hindi nako pinagbayad ng termination fee eh natanggap ko narin ung full refund ko na P1,988 from the SMARt wireless center. Basta ba isuli nyo ng kumpleto ung antenna or equipments nyo eh. Mismong manager pa ng SMART ang nag-assist sa problem ko at prinioritize dahil nga sinulatan ko NTC at sinabon sila.
Awa ng Dios eh masaya na ang aking Bagong taon, at naibalik pa ung pera ko. hayy. sana lang eh makahanap naman ako ng stable pero mura na broadband ayaw ko na ng PLDT o SMART me phobia nako jan. Sayang di available Globelines dito sa Soldiers Hills, Alabang eh. baka Cable Internet nalang. ok kaya un?
Dibale mag-research muna ako para hindi na ako maperwisyo at maloko ng tulad ng SMART Microwave nayan ehe.

Wala tayong choice kundi magsubscribe sa substandard service ng mga putang inang ISPs na yan…
Subscriber ako ng Globe Visibility –> UNLIMITED 3G Internet anytime, anywhere (in 3G enabled sites).. e putang ina, 3G enabled tong lugar ko, sa GPRS lang ako nakaka-connect, 3 less than 50kbps lang nakukuha ko… e putang ina P2000/month binabayaran ko.. lintek.. maniwala kayo o hindi, mas mabilis pa ang Smart Bro ko sa probinysa (pag di umuulan)… P999/mo lang…
