Fair Use Policy: Globe vs. Smart compared

The idea of a Fair Use Policy is nothing new and has been enforced, albeit discreetly, by telcos on a case to case basis. Both Smart and Globe have their own version of the Fair Usage Policy for their network services, be it SMS, calls and mobile internet.

That means any or all of the “unlimited” SMS, calls or mobile internet offers that the telcos offer have a numerical limit. That means if you subscribe to unlimited SMS for 1 day and you send out 1,000 messages in 1 hour, you will be cut off by the telco. Same is true with voice calls and mobile internet.

This measure is done to prevent abuse of the network. Besides, we also don’t want SMS spam or email spam right?

Of course, these Fair Use Policy has their own specifics on what is acceptable and normal usage. Smart has made it a standard to have new subscribers sign a waiver stating they agree to these FUP. Globe has a similar one but it’s on fine print.

Here’s the information we have on both Globe and Smart Fair Use Policy. They are lifted from their website, subscriber contracts and waivers.

Base don surveys from different postpaid subscribers of both Smart and Globe, these restrictions are not really observed. That is why we have folks who are still able to use their LTE connection way beyond the one indicated in the FUP (so lucky you if you are one of them who are heavy users but still enjoy the unlimited LTE speeds).

Our understanding is that this FUP are put in place as a legal safeguard to immediately allow the network or the telco to take action in cases where there is blatant disregard or exploitation of the network resources. We’ve personally experienced and recorded what happens if you reach your data cap (see story here 24).

Note though that there are exceptions to this FUP. Smart considers data roaming as an exception since you are billed by the KB or MB by the partner carrier. Globe exempts PowerSurf from the 1GB per day limit since that promo has its own bandwidth allocation.

And based on our research from all 12 or so other countries that we’ve visited last year and used their mobile internet, ALL of them have these Fair Use Policy. It’s only a matter of how much SMS or bandwidth is actually considered normal use.

Our suggestion — call a spade a spade. If it’s 3GB per month, then call it 3GB. If it’s just 1.5GB allocation, don’t call it unlimited. That’s how they do it in other countries.

    Pabor sa akin ang FUP na yan dahil hindi naman ako masyado heavy user. Hehehe. At dapat lang kasi ang daming nagda-download ng movies sa Internet, inaabuso nila yung connection nila porke unli sila. Sagad-sagad kung gumamit. Buti nga sa inyo. Try nyo rin kasi bumili ng legal copies o mag-rent na lang ng DVD. Unlidata rin po ako pero I can say na fair user ako dahil I understand na may iba ring gumagamit ng service at nakakaapekto ito sa performance ng connection. By the way, I tried downloading 1.5 GB concert (though not legal. hehehe) na 1080p sa youtube pero okay naman siya at nag-download din ako via iTunes ng 1.24GB na iOS 7.0.6 at tuloy tuloy naman. Nagawa ko lahat yan sa 3G network, 2-bar lang ang signal, GLOBE. Samantalang sa SMART, sinubukan ko rin mag-download dati nung iOS 7.0.0 pero hindi nag-succeed at take note, mga 200kbps lang ang speed samantalang sa GLOBE umaabot ako ng 300-900 kbps. Also, 1.5GB ang cap ng SMART per month samantalang 1GB/day at 3GB/month sa GLOBE. Well, based lang naman yan sa experience ko. Kaya go lang ako nang go sa GLOBE! :)

      Hooy peste ka… kasama sa benefits yan kaya nga nagunli mag download ka 100gb per day di dapat bagalan o limitahan…. kaya nga unlimited kasama yan sa banefits ng unlimited from the word itself UNLIMITED…punta ka saudi qatar bahrain at iba pa bansa kulelat ang pilipinas at pipitsugin ang network natin 21mbps po speed namin dito para sa pagkakaalam mo at nasa 50gb ang nadownload ko per day… kasi nga unli…. walang limit kaya di dapat limitahan… kung lilimitahan niyo dapat lang pasabugin ng NPA ang mga cellsite nio… haha….

      engot ka pala eh, fair use kuno, its just a word, maganda lang sa pakinig mo,, pero sa kanila its a moneymaking scheme pa rin, inadvertise nila “unlimited” yet it no where near unlimited eh sa browsing nga lang ang bagal bagal na, what more kapag download na? Marami ka sigurong pambili at pambayad sa wala,, thats right kase kapag nakasubscribe ka sa globe, smart or pldt is like paying monthly for nothing.

    Just got a text message from globe that a reach my daily limit of 1gb. I was shock and immediately search about the FUP. There i find that if I exceeded 3gb a month then i’ll be on 2g connectiion for the rest of the month. Globe… Are you f**king serious!? You want me to pay 999php a month for 3gb usage? Oh like that’s f**king fair! I’ll give them two weeks to turn this around, after that, if this cap still there, then i’ll f**king cut my line off. How’s that fair for you greedy telcos!? Ginagawang gago mga tao dito eh! I signed up for unlimited data usage which by the way, you spent millions to advertise! 3gb a month… You guys must be sh!tting me right!?

    Well i dont mind having a 1gb limit per day as long as its per day, but having informed falsely with their BS unli data ads while having 3gb limit per month is shit! Telcos are like saying ok you fucktards enjoy our blazing fast speed internet(as they’ve advertised,)up to 3gb/1.5gb per month once youve reached the limit go ahead and stick your smartphones on your ass coz that shit will be useless for the rest of the month.
    Its 2014 why offer a smartphone for your data plans if it’ll be throttled to a 2g connection? Why not offer a Nokia3310 so we can enjoy texting all we want 2G connection? Thats more primitive than dinosaurs ehh? (Figure of speech for those dumbass that will react)

      Dude its just a matter of paying something you’ve purchased
      Unli data plan/Unli LTE plan is far way different on every aspects from
      Capped Data/Internet plan,the word prerogative cant be used here as well globe reinforced FUP on every user of their service while initially they said that its Unlimited and i bet you know what this word means.
      You cant say that we should be thankful to telcos mainly because we can communicate with our loved ones, we are paying for the services they are offering and this FUP shit isnt part of the service that we’ve subscribed on the first place.

    Philippine telecoms are all full of b.s. I think if there should be complaints it should be about the cost of services here. Philippine telecoms say that their prices are competitive because it’s similar to that in the US. But comparing them, the US has one of the most expensive telecoms but at least they boast speeds that are twice as fast as what we get here. In short not only do these telecoms are f*ing expensive but they are dinosaurs and now they are putting caps on the max data. How is it possible that our lte is slower than hspd of other countries? Something is wrong with the way things run here.

    Wala bang online petition for postpaid mobile subscribers? Yung petition is for business plans pero tayong ordinary postpaid subscribers who are paying fair and square na nag sign up for unlimited lte or at least 3g connection e niloloko rin ng Globe! I’m sure most of you are still on their lock up period. This is not what we signed up for. This is one unfair.

    dahil ito sa FREE FB nila. kaylangan nila ng
    bandwidth. this is too familiar remember nung ng boom yung globe GCASH?
    and they got too greedy about it. and want more money to do a
    transaction via GCASH, now GCASH IS DEAD… right now eh cguro nakita nila
    potential ng free fb sa mga prepaid users. (via the borrowing system)
    kumikita sila kahit not outright,pero pag nagload na automatic bawas na
    yung hiniram mo. now neglecting your postpaid user will be damaging to
    your image of best postpaid service. and you whole postpaid user will
    dwindle like your GCASH users!

    I hope smart will make a jump about this and offer a no cap service, I
    bet they will double or triple their postpaid account.. corporate globe
    being greedy again!
